ByFly Taxi Invitation Network Rules

Version kz-2026-10-31.1 · effective from 01.11.2026

ByFly Group LLP (BIN 261040023460, address: Республика Казахстан, г. Алматы, ул. Айтеке би, д. 100, н. п. 71) (hereinafter "ByFly"). Edition kz-2026-10-31.1 dated 01.11.2026. Country: Kazakhstan; first city: Almaty. Rules page: https://byfly-shop.com/taxi/legal/network_rules.

1. General provisions

1.1.These rules describe how an inviter is linked in ByFly Taxi and what accruals arise from the trips of invited people. The rules form part of the contract (offer) of the driver, the rider and the partner and are accepted in the app together with it. They can be read before registration.

1.2.Participation is free. There is no entry fee, and there are no paid levels, statuses or packages. Participation does not depend on buying ByFly training or other services. Nothing is accrued for the invitation itself: accruals arise only from paid trips. Participants pay neither ByFly nor each other for participation, a code or a place in the network; charging such a fee is prohibited (point 9.4).

1.3.ByFly does not promise any accruals. There may be none at all. Their amount depends on trips, on meeting the conditions (section 5), on the rates (section 6) and on the per-trip limit (section 7).

1.4.The rules apply from 01.11.2026 and only to the future: trips made before that date are not taken into account under them. Changes are made by a new edition. It is published in the app no later than 10 days before it takes effect, has effect only for the future and applies to a participant after they have accepted it in the app. Amounts accrued under the previous edition are kept. Anyone who does not agree with the new edition may leave the network in the app.

1.5.Participation is open from the age of 18. The rider confirms "I am 18 or older" in the app; the driver's age is checked against documents. No accruals are made to participants under 18. A rider who has not confirmed their age does not receive points.

1.6.The rules apply to all ByFly Taxi services in Kazakhstan. The conditions for intercity, delivery, courier, food and cargo services apply from the launch of these services in the city — the app will announce the launch. In these rules, a "trip" also means an order for such services, a "driver" also means the person performing them (a courier, an intercity or cargo driver), and a "rider" also means their customer.

2. Inviter

2.1.There can be only one inviter, and the inviter is linked permanently. The inviter cannot be changed.

2.2.An inviter is linked in one of two ways: you register with their code, or you enter the code yourself, once and within 7 days after registration. A link, a QR code and manual entry all work with the same code of the form BF-XXXXX.

2.3.During the first 7 days after registration, the app may show a ByFly tourist the checkbox "My agent (agent's name) is my inviter". It is not ticked in advance. If the tourist ticks it, the agent becomes the inviter. If the tourist declines, there is no inviter, but a code can be entered during these 7 days. The checkbox can be answered only once. The checkbox is shown only if the agent has accepted the Offer for ByFly Agents; it does not affect the prices or conditions of the tourist's trips.

2.4.Without a code or the checkbox, there is no inviter. An inviter is not assigned automatically.

2.5.A code is not accepted if:

2.6.If an inviter deletes their account, their invitees pass to the inviter's own inviter.

3. Lines and the network day

3.1.Line 1 is the people you invited. Line 2 is the people they invited, and so on down to line 5. Nothing is accrued for the trips of people deeper than the fifth line.

3.2.Each trip gives accruals to two chains: upwards from the driver of the trip (the driver chain) and upwards from its rider (the rider chain).

3.3.When lines are counted, the following are skipped (this is called compression):

The place of a skipped participant in the line is taken by the next person further up the chain.

3.4.The network day runs from 04:00 to 04:00 city time; the day is calculated at 04:30. A trip belongs to the day on which it was paid. If that day has already been calculated, the trip moves to the next one.

4. Accrual base and counted trip

4.1.The accrual base is the part of the trip price under the tariff that was paid with money. It does not include the demand surcharge, zone fees, tips, paid waiting, the cancellation fee, points or promo. For an unpaid, cancelled or refunded trip, the base is 0. The base is also 0 for a trip in which the driver and the rider have a shared device or a shared bank card.

4.2.Counted trips are needed for the driver's personal minimum (section 5). A trip is counted if all the conditions are met:

For food delivery, the customer is the venue, so the rider and pair checks are not carried out for it.

4.3.A trip that is paid but not counted does not go towards the minimum, but accruals along the lines are calculated from it, except for a trip with a shared device or card (point 4.1).

5. Conditions under which accruals are made

5.1.Driver. The lines of the day are opened by the personal minimum — activity points for the network day. Activity points are only units of account for the minimum: they are not rider points and not money, and they cannot be spent. A counted taxi trip, delivery, courier or food order — 1 point; intercity — 1 point for each full 25 km of the route, but at least 1; cargo — 1 point for each full paid hour of work, but at least 1:

5.2.Rest day. The six days before this day are checked. If on each of them the driver reached at least the first tier (5 points) and none of them was a rest day, this day gets the lowest tier of the six, even if it has fewer points. A rest day is marked automatically, so it occurs no more than once in seven days.

5.3.If the service was down for 30 minutes or more, the thresholds of that day are reduced in proportion to the downtime (but not below 1 point).

5.4.All 5 lines are open to a rider if, in the 30 days ending on that day, they have at least 2 paid trips of their own.

5.5.A partner is a ByFly agent who has accepted the Offer for ByFly Agents in the app. Lines 1–2 are open to a partner without a minimum. The partner's accruals are money in tenge in a separate "for payout to partner" account (not reward credit and not points); they are made from the first paid trip, including during the pilot. How and when the money is paid out is set out in the Bonus and Reward Credit Rules (section 5) and in the Offer for ByFly Agents. A partner who is also a driver receives for the day the better of two options: as a partner (lines 1–2, money) or as a driver (lines by personal minimum, reward credit).

5.6.Accruals are not made:

6. Rates

6.1.An accrual is a share of the trip base (point 4.1). It arises only when the conditions of section 5 are met and within the limit of section 7.

6.2.The rate is determined by the chain, and the type of accrual by the recipient's role. A driver receives reward credit, a rider — points, a partner — money. Details are in the Bonus and Reward Credit Rules.

6.3.If the recipient on a line has not met the conditions, their share is forfeited: it is not passed further up and is not divided among others. If there is no one on a line, the share is not accrued to anyone.

6.4.Amounts are rounded down to the tiyn, and the remainder stays with ByFly.

7. Per-trip limit

7.1.All accruals for one trip taken together (both chains, all lines) may not exceed ByFly's remuneration for this trip excluding VAT, less the trip's direct costs. Direct costs are:

7.2.If the total of accruals is higher, the furthest lines are cut: first the rider's line 5, then the driver's line 5, the rider's line 4 and so on. The driver's line 1 is cut last.

7.3.City launch. If the city's launch commission rate is applied to a trip (rule start_5: 5 % for 60 days from launch), accruals are made at the full rates, and ByFly pays everything above the limit on top. This exception does not apply to the welcome rate of an invited driver (rule welcome_5).

8. Statuses and time limits

8.1."Under review" — if there is a review flag or an open case (a complaint, a dispute) for the trip. During the first 14 days after the service opens in the city, all accruals to drivers and partners get this status. The status lasts up to 72 hours after the day is calculated. If there is no decision within this time, the accrual moves on. Points are not placed under review.

8.2."Pending" — 1 day after the day is calculated. For new participants — 7 days. A new participant is a person who has been in the network for less than 30 days, or a driver with fewer than 100 counted trips; a partner — during the first 30 days.

8.3.After that, reward credit becomes available for offset, and partner money becomes available for payout: from that moment this money is ByFly's obligation to the partner. Points are available immediately after the day is calculated (ByFly Taxi Bonus and Reward Credit Rules).

8.4.If a trip is cancelled, the money for it is refunded or fraud is confirmed, the accruals from it are cancelled. If they have already become available, they are removed by a reversal entry (ByFly Taxi Bonus and Reward Credit Rules); partner money — only until it is paid out. Money already paid out to a partner is not removed by a reversal entry: it may be returned only under the law or with the recipient's written consent. There are no other cancellations of available accruals, and they are not recalculated retroactively; accruals not yet available are also cancelled during a pause (point 9.3).

9. Collusion and other violations

9.1.Signs of collusion:

Such trips are not counted (point 4.2). If there is a review flag for a trip, accruals from it to drivers and partners are "under review" (point 8.1).

9.2.A decision on a violation is made by two different staff members.

9.3.If collusion is proven, accruals are paused: they are not made from the date of the first sign of the violation until 30 days after the decision. Accruals for this period that have not yet become available are cancelled. Those already available are not cancelled. ByFly states the reason for the decision in the app; an objection can be raised in the manner set out in point 9.6.

9.4.If collusion is proven again within 90 days after the previous decision, the participant is excluded from the network indefinitely. They receive no further accruals, and they are skipped when lines are counted (point 3.3). Two staff members may also block a participant or exclude them from the network for other proven violations:

9.5.During a review, ByFly may withhold a payout to a driver only for disputed orders and for no longer than 14 days (driver agreement, point 6).

9.6.A decision can be appealed within 90 days in the "Support" section of the app. The first answer comes within 24 hours. A complaint about a pause or an exclusion is considered by two staff members within 7 days. Until the decision is reconsidered, it remains in force.

10. "My network" and data

10.1.In the "My network" section you see the person who invited you and your first line in the form "First name S.". For lines 2–5 only numbers are visible: how many people there are, how many of them are active, the turnover and the accruals for the line. No one's phone number is visible.

10.2.Personal data is processed under the ByFly Taxi Privacy Policy and the consent to the collection and processing of personal data. The inviter sees only what is stated in point 10.1.

11. Reward for an invited venue

11.1.If a venue has registered with ByFly using your code (or named you at registration, if you are a ByFly agent) and you are assigned to it within 7 days after its registration, you receive 5 % of ByFly's remuneration excluding VAT from each paid and delivered order of this venue for 12 months from the date of assignment. The reward comes out of ByFly's remuneration: it does not change the price or the terms for the venue.

11.2.The inviter is assigned once and for all; the owner of a venue cannot be its inviter. Only the person who invited the venue receives the reward; lines and the personal minimum do not apply to it. The type of reward depends on your role (point 6.2): a driver — reward credit, a partner — money, everyone else — points.

11.3.The reward is not accrued for training orders, to participants under 18, during a pause (section 9) or to those who have been blocked, have had their account deleted or have been excluded from the network. Statuses, time limits and cancellations are the same as for other accruals (section 8).

Annex. Conditions of a counted trip

1. Order module. A taxi or intercity trip is counted by the order module only if all the conditions are met:

1)the trip is paid: the driver confirmed receiving cash, or the confirmation came automatically when the time limit expired, or a card payment went through; if the driver marked that the rider did not pay, the trip is not counted;

2)the driver was assigned by the system: the driver accepted an offer from the system or a dispatcher, for intercity — took the order through a booking; an order that a staff member assigned to the driver manually is not counted;

3)distance — at least 2 km;

4)time — at least 5 minutes;

5)final price — not less than 400 ₸;

6)the price contains no promo discount.

Distance and time are taken from the trip data recorded when the trip ends, and the final price is the one on the receipt. The order module's decision is made when the trip ends and does not change afterwards; if the trip is later cancelled, the money for it is refunded or fraud is confirmed, the accruals from it are cancelled under point 8.4. The order module neither counts nor rejects delivery, courier and food orders — they are counted by the network (Part 2). The order module always counts a cargo order; everything else, including payment, is checked by the network.

2. Network thresholds by type of service (together with the conditions of point 4.2):

The thresholds are the same for the whole of Kazakhstan and are changed only by a new edition of these rules (point 1.4). The conditions for intercity, delivery, courier, food and cargo apply from the launch of these services in the city (point 1.6).
